1. Scope and provider

These terms apply to every purchase of the software KistePix through the website kistepix.com. The provider and contracting party is Sascha Rust, Birkenweg 2, 5502 Hunzenschwil, Switzerland (the "provider"); full details are in the legal notice.

2. Subject of the contract

The subject is the supply of the KistePix software as a digital download (installer and portable version for Windows). This is a one-time purchase, not a subscription.

KistePix can alternatively be built from source free of charge. The purchase price is paid for the ready-built, installable version.

3. Conclusion of contract

The presentation of the software on the website is a non-binding invitation to order. By completing the payment process the buyer makes a binding offer. The contract is concluded as soon as the payment is confirmed and the download is released.

4. Price and payment

The price stated on the website applies (currently CHF 14, one-time). The provider is not registered for VAT; no VAT is charged or shown.

Payments are processed by the payment service provider Stripe, whose terms apply in addition. The provider never receives full credit card details.

5. Delivery

Delivery takes place immediately after confirmed payment, as a download via a protected link. The file can also be downloaded again at any later time through the page "Download again", using the e-mail address given at purchase.

No physical media are shipped.

6. Right of withdrawal for digital content

Consumers resident in the European Union generally have a 14-day right of withdrawal for distance contracts.

7. Licence

The purchase grants a simple, perpetual, non-exclusive right to use KistePix on your own devices, privately and commercially. Works created with KistePix (images, animations, sprite sheets) belong entirely to you; the provider makes no claim to them.

It is not permitted to resell the purchased program file, offer it publicly for download, or present it as your own product.

8. Updates

All future versions of KistePix are included in the purchase price and can be obtained via the page "Download again". There is no entitlement to further versions being released. The provider promises neither a particular feature set of future versions nor that they will appear at all.

9. Warranty

The software is supplied in its current version. The provider warrants that the software substantially performs the functions described on the website. It is not warranted that the software is free of errors, runs without interruption, or is fit for any particular purpose.

If a defect appears, the provider will endeavour to fix it in a future version. Bug reports are welcome at fehler@kistepix.com.

10. Liability

The provider is liable without limitation for damage arising from injury to life, body or health, and for damage caused intentionally or through gross negligence. Otherwise liability is limited to foreseeable damage typical of this type of contract, and in any case to the amount of the purchase price.

Liability for loss of data exists only to the extent that the loss would not have occurred had the user maintained proper and regular backups. Mandatory statutory claims remain unaffected.

11. Data protection

Which data are processed when you buy and when you visit the website is set out in the privacy policy.

12. Governing law and jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is the provider's domicile, unless mandatory statutory provisions — in particular in favour of consumers — require otherwise.

13. Final provisions

Should any provision of these terms be invalid, the validity of the remaining provisions is unaffected.
